These Website Terms & Conditions (the “Terms”) govern your access to and use of www.michelemooreofficial.com, its subdomains, and any related pages, digital resources, social media accounts, and online content operated in connection with Michele Moore’s professional work (collectively, the “Sites”).

These Terms should be read together with the Privacy Policy available on www.michelemooreofficial.com, which is incorporated into these Terms by reference. By accessing or using any of the Sites, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Sites.

I may update these Terms from time to time. Changes become effective when posted, unless otherwise stated. The “Last modified” date above identifies the most recent revision. Your continued use of the Sites after revised Terms are posted constitutes acceptance of those revised Terms to the extent permitted by applicable law.

1. SITE CONTENT AND PURPOSE

The Sites provide information about Michele Moore’s professional work, including elite player development, high-performance skating, athlete progression, coach education, speaking, media, partnerships, collaborations, and related professional services and opportunities.

The Sites may include educational and informational content concerning hockey development, skating technique, movement efficiency, athletic performance, mindset, resilience, leadership, coaching, and sport development. Site Content is provided for general informational and educational purposes only and is not a substitute for individualized coaching, medical advice, diagnosis, treatment, physiotherapy, mental-health care, or other professional healthcare services.

Accessing the Sites, viewing Site Content, submitting an inquiry, or communicating through a website form does not by itself create a coach-athlete, consultant-client, instructor-participant, or other professional relationship. Any formal engagement is subject to the applicable registration, service agreement, waiver, release, consent, or other written terms governing that engagement.

Athletic activity involves inherent risks. Any athlete or participant is responsible for following appropriate supervision, facility rules, coaching direction, safety protocols, and medical guidance applicable to their circumstances.

2. NO GUARANTEE OF RESULTS

Athlete development is individual. I do not represent, promise, or guarantee any particular athletic, performance, career, roster, team-placement, scholarship, recruitment, professional, financial, or other outcome from accessing the Sites, consuming Site Content, or participating in any service or opportunity described on the Sites.

Results depend on many factors outside my control, including an individual’s experience, health, physical capacity, effort, consistency, training environment, coaching, competition, opportunity, and other circumstances. Testimonials, examples, case studies, or descriptions of past outcomes are illustrative only and do not guarantee future results.

3. INTELLECTUAL PROPERTY

Unless expressly stated otherwise, the Sites and all original content made available through them - including written copy, articles, educational materials, photographs, graphics, videos, audio, training concepts, frameworks, presentations, branding, logos, names, slogans, designs, and downloadable resources (collectively, “Site Content”) - are owned by or licensed to Michele Moore and are protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Sites and Site Content for your own lawful, personal, non-commercial use. No ownership rights are transferred to you.

Without prior written permission, you may not reproduce, republish, copy, modify, distribute, sell, licence, commercially exploit, publicly display, transmit, scrape, systematically download, create derivative works from, or otherwise use Site Content except as permitted by applicable law.

4. ARTIFICIAL INTELLIGENCE (AI)

Artificial intelligence and other technology-assisted tools may be used from time to time to support research, ideation, editing, design, transcription, production, organization, or other aspects of content creation and business operations.

Technology-assisted content may contain errors or omissions. Site Content should therefore be evaluated in context and should not be treated as individualized professional, medical, legal, or financial advice. I reserve the right to revise or remove Site Content at any time.

5. THIRD-PARTY CONTENT AND INTELLECTUAL PROPERTY RIGHTS

The Sites may include or reference content owned by third parties, including photographs, video, quotations, trademarks, platform features, or other materials (“Third-Party Content”). Third-Party Content remains the property of its respective owner and is used only where permission, licence, attribution, or applicable law permits.

You may not copy, redistribute, republish, or commercially exploit Third-Party Content unless you have permission from the applicable rights holder or your use is otherwise permitted by law.

If you believe material appearing on the Sites infringes your intellectual property rights, please submit a notice through the contact form on www.michelemooreofficial.com identifying the protected work, the allegedly infringing material, your contact information, the basis for your claim, and confirmation that the information supplied is accurate and submitted in good faith.

6. ACCEPTABLE USE

You agree to use the Sites only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use of the Sites by any other person.

You may not attempt to gain unauthorized access to the Sites or related systems; introduce malicious code; interfere with Site security or functionality; impersonate another person; submit false, misleading, unlawful, defamatory, abusive, or infringing material; harvest personal information from the Sites; or use automated systems to extract Site Content in a manner that violates these Terms or applicable law.

I may restrict, suspend, or terminate access to the Sites where I reasonably believe these Terms have been violated or where necessary to protect the Sites, users, intellectual property, security, or legal rights.

7. LINKS TO AND FROM THIRD-PARTY SITES

The Sites may contain links to third-party websites, services, platforms, publications, organizations, teams, sponsors, partners, or social media accounts. These links are provided for convenience or informational purposes and do not necessarily constitute an endorsement.

I do not control third-party websites and am not responsible for their availability, security, accuracy, content, products, services, privacy practices, or terms. Your use of third-party websites is at your own risk and subject to the terms and policies of those third parties.

Any person or organization linking to the Sites must do so lawfully and must not falsely imply sponsorship, endorsement, affiliation, or approval by Michele Moore.

8. ADVERTISING, SPONSORSHIPS, PARTNERSHIPS, AND AFFILIATE LINKS

The Sites or related communications may from time to time include sponsored content, partnerships, brand collaborations, advertisements, promotional relationships, or affiliate links. Where disclosure is required, reasonable efforts will be made to identify the commercial nature of the relationship in accordance with applicable advertising and marketing requirements.

If you purchase a product or service from a third party through an advertisement, referral, affiliate link, or collaboration, the transaction is between you and that third party unless expressly stated otherwise. I am not responsible for a third party’s products, services, acts, omissions, representations, warranties, or fulfilment.

9. USER SUBMISSIONS AND COMMUNICATIONS

If you voluntarily submit an inquiry, testimonial, comment, message, photograph, video, document, or other material through the Sites or in connection with a professional relationship, you represent that you have the right to submit that material and that doing so does not violate another person’s rights or applicable law.

Submission of material through a general website form does not make that material confidential unless confidentiality has been expressly agreed to in writing. Please do not submit sensitive, medical, financial, or other confidential information through a general website form unless it is reasonably necessary and an appropriate secure process has been provided.

10. MINORS

Because Michele Moore’s work may involve youth athletes, parents and legal guardians are responsible for supervising a minor’s use of the Sites and for submitting inquiries or consents on a minor’s behalf where appropriate.

The Sites are not intended to establish a direct professional relationship with a minor solely through website access or a general inquiry form. Participation by minors in programs or services may require parental or guardian consent, waivers, releases, registrations, and other applicable documentation.

11. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITES AND SITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

I DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE FROM HARMFUL COMPONENTS, OR THAT ALL INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR ACCURATE. NOTHING ON THE SITES CREATES A WARRANTY OR GUARANTEE OF PERFORMANCE OR RESULT.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MICHELE MOORE AND ANY APPLICABLE AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, REPRESENTATIVES, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS TO, USE OF, RELIANCE ON, OR INABILITY TO USE THE SITES OR SITE CONTENT.

YOUR USE OF THE SITES AND RELIANCE ON SITE CONTENT ARE AT YOUR OWN RISK. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. WHERE A JURISDICTION DOES NOT PERMIT A PARTICULAR EXCLUSION OR LIMITATION, THAT EXCLUSION OR LIMITATION APPLIES ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Michele Moore and applicable affiliates, contractors, service providers, representatives, licensors, and agents from claims, liabilities, losses, damages, costs, and reasonable legal expenses arising from your unlawful use of the Sites, your violation of these Terms, or your infringement of another person’s rights.

14. PRIVACY

Your use of the Sites is also subject to the Michele Moore Privacy Policy available at www.michelemooreofficial.com. The Privacy Policy explains how personal information may be collected, used, disclosed, retained, and protected in connection with the Sites.

15. AVAILABILITY, MODIFICATION, AND TERMINATION

I may modify, suspend, discontinue, remove, or restrict any portion of the Sites or Site Content at any time, with or without notice, subject to applicable law. I am not responsible for loss or inconvenience arising solely from the modification, suspension, or discontinuation of the Sites.

16. SEVERABILITY AND WAIVER

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

A failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

17. GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising from or relating to the Sites are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to any rights you may have under mandatory consumer-protection or other applicable laws, you agree that disputes relating to these Terms or the Sites will be submitted to the courts located in Ontario, Canada.

18. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional written terms that expressly apply to a particular service, program, purchase, registration, or engagement, constitute the applicable agreement concerning your use of the Sites. If separate written terms govern a paid service or program and conflict with these website Terms, the specific written terms for that service or program will control to the extent of the conflict.
